How to Ban Guns Without Banning Guns
Tyrants don’t need gun laws — not if they have lawsuits. Statist John Culhane, a law school professor writing in Slate, wants to repeal the Protection of Lawful Commerce in Arms Act:
[T]he PLCAA eliminated most tort claims anyone might bring against the manufacturers and other sellers of guns, and did so for past and well as future misconduct.
This spoiled the fun for Culhane, who had been developing an argument that
people injured by gun violence, and cities bearing the financial cost of that violence, should be able to sue sellers. David Kairys at Temple Law School was making similar arguments. And courts had started to see things our way.
Why wouldn’t they? Courts are overwhelmingly dominated by authoritarian liberals.
Suing everyone in sight when someone gets shot by a criminal would allow libs to loot every link of the supply chain — manufacturers, distributors, and dealers — driving all of them out of business with the gargantuan jackpots often awarded in tobacco suits. A large percentage of the proceeds would be kicked back through pathologically greedy trial lawyers into the Democrat Party, which would appoint still more anti-gun judges.
Best of all for liberals, they will be able to argue that they are not directly violating the Constitution. Sure you can have a gun — except no one makes them for private ownership anymore.
