A 5-year-old Pennsylvania girl who told another girl she was going to shoot her with a pink toy gun that blows soapy bubbles has been suspended from kindergarten.

Her family has hired an attorney to fight the punishment, which initially was 10 days but was reduced to two.

Attorney Robin Ficker says Mount Carmel Area School District officials labeled the girl a ‘terrorist threat’ for the bubble gun remark, made on January 10 as both girls waited for a school bus.

Ficker says the girl didn’t even have the bubble gun with her and has never fired a real gun. He says she’s ‘the least terroristic person in Pennsylvania.’

According to Ficker, school officials heard about the conversation and questioned the girls for 30 minutes the next day.

Pennlive.com reported that the children’s parents were not informed this meeting was taking place.

But the 5-year-old was deemed a ‘terrorist threat’ and suspended for 10 days. The school then required the girl to have a psychological evaluation.

School officials also required that the girl was sent for a psychological evaluation, after which the punishment was reduced from 10 days to 2

When the psychologist said she was not a danger to others, district officials reduced the suspension from ten days to two days.

But the girl still has the incident on her record. Ficker intends to have this expunged and that the student is offered an apology.

School district solicitor Edward Greco told Pennlive that officials are looking into the case. He said on Friday that school officials aren’t at liberty to discuss disciplinary action.

A Philadelphia elementary school student was scolded and searched by administrators in front of her entire class after she pulled out a paper gun in class last week, according to her mother.

Melody Valentin’s mother, Dianna Kelly, tells Fox 29 that school officials went too far when they reportedly punished her daughter for pulling out the gun, which she says looks like a folded sheet of paper.

Fox 29 reports that one of the fifth grader’s classmates reportedly saw the paper gun and notified administrators as she was going to throw it away.

“He yelled at me and said I shouldn’t have brought the gun to school and I kept telling him it was a paper gun but he wouldn’t listen,” Melody tells Fox 29.

Kelly says school staff searched her daughter while other students watched.

The gun was made by Melody’s grandfather, according to Kelly, who says her daughter has suffered nightmares as a result of the incident.

Kelly says she is keeping Melody out of school to avoid harassment. Calls made by FOX 29 to district administrators were not returned.
